ORDINANCE 12 -1384 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING THE CITY OF CASSELBERRY CODE OF ORDINANCES, <br />PART III, SEC. 3 -10.9, "PARKING OF VEHICLES IN RESIDENTIAL <br />DISTRICTS ", TO PROVIDE CLARIFICATION OF THE FREQUENCY TO <br />WHICH RECREATIONAL EQUIPMENT MAY PARK OVERNIGHT WITHIN <br />RESIDENTIAL DISTRICTS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry adopted Ordinance 07 -1215 on June 11, 2007 to regulate the <br />parking of recreational equipment within residential districts; and <br />WHEREAS, the City Commission of the City of Casselberry finds that the overnight parking of certain <br />types of recreational equipment on residential properties is not detrimental to the health, safety and welfare of <br />the citizens of Casselberry; and <br />WHEREAS, the City Commission of the City of Casselberry finds it necessary to clarify the frequency <br />in which recreational equipment may park overnight in the driveway of a residential property; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text and stNke <br />through shall constitute deletions to the original text. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, <br />Florida: <br />SECTION 1. That Section 3 -10.9, Parking of recreation vehicles in residential district, Part III <br />Unified Land Development Regulations, Chapter III Performance Criteria, Article X Appearance, design and <br />compatibility of the Code of Ordinances of the City of Casselberry, Florida shall be amended as follows; <br />C. Recreational equipment. Recreational equipment includes recreational vehicles (RV); motor homes; <br />boats; trailers designed to carry recreational equipment; all- terrain vehicles (ATVs); campers; pickups <br />with a mounted camper; and similar equipment; motorized or not, for the resident's individual and <br />personal use and licensed to the property owner /resident where it is located. <br />2. Additional requirements for recreational equipment. <br />a. At no time shall recreational equipment be used as a residence while stored or parked <br />on residential property. <br />b. Recreational equipment may be parked overnight in the driveway or designated parking <br />area of a residential property for the sole purpose of loading, unloading, or cleaning. <br />Overnight parking shall not occur more than one consecutive 24 hour period. <br />c. If the recreational equipment cannot be parked in the locations provided in Section 3- <br />10,9,0, the recreational equipment shall be removed from the residential district. <br />
