ORDINANCE 12 -1381 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE III, OFFICERS AND EMPLOYEES, DIVISION 2, CITY MANAGER, OF THE CITY CODE OF ORDINANCES; AMENDING SEC. 2 -101 REGARDING APPOINTMENT AND QUALIFICATIONS; AMENDING SEC. 2 -105 REGARDING REMOVAL AND SEC. 2- 106, POWERS AND DUTIES, TO BE CONSISTENT WITH CITY CHARTER PROVISIONS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE. WHEREAS, the City Commission desires to broaden the qualifications for the City Manager in order to ensure the most qualified individuals will apply for and be eligible for the position; and WHEREAS, the City Code of Ordinances contains language that is unnecessarily redundant to language contained in the City Charter as a result of the passage of City Charter amendments in 2008 and 2012; and WHEREAS, the City Commission finds it necessary to modify language in Chapter 2 of the City Code relating to the City Manager in order to be consistent with the City Charter; and WHEREAS, words with bold double underlined type shall constitute additions to the original text and stfike thretigh shall constitute deletions to the original text of Section 2 -101, Section 2 -105, and Section 2 -106 of the City Code of Ordinances. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA AS FOLLOWS: SECTION 1. That Section 2 -101, "Appointment, qualifications" of Article III, Chapter 2 of the City of Casselberry Code of Ordinances is amended to read as follows: Sec. 2 -101. - Appointment; qualifications. (a) Appointment generally. The City Commission shall appoint a City Manager of the City government pursuant to Article V, Section 2-3 5.01, of the City Charter, who shall serve as the chief executive, administrative and enforcement officer of the City in accordance with the City Charter, ordinances, resolutions, and rules and regulations established by the Commission time to time.
