ORDINANCE 12 -1381 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE III, <br />OFFICERS AND EMPLOYEES, DIVISION 2, CITY MANAGER, <br />OF THE CITY CODE OF ORDINANCES; AMENDING SEC. 2 -101 <br />REGARDING APPOINTMENT AND QUALIFICATIONS; <br />AMENDING SEC. 2 -105 REGARDING REMOVAL AND SEC. 2- <br />106, POWERS AND DUTIES, TO BE CONSISTENT WITH CITY <br />CHARTER PROVISIONS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE. <br />WHEREAS, the City Commission desires to broaden the qualifications for the <br />City Manager in order to ensure the most qualified individuals will apply for and be <br />eligible for the position; and <br />WHEREAS, the City Code of Ordinances contains language that is unnecessarily <br />redundant to language contained in the City Charter as a result of the passage of City <br />Charter amendments in 2008 and 2012; and <br />WHEREAS, the City Commission finds it necessary to modify language in <br />Chapter 2 of the City Code relating to the City Manager in order to be consistent with the <br />City Charter; and <br />WHEREAS, words with bold double underlined type shall constitute additions to the <br />original text and stfike thretigh shall constitute deletions to the original text of Section 2 -101, <br />Section 2 -105, and Section 2 -106 of the City Code of Ordinances. <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA AS FOLLOWS: <br />SECTION 1. That Section 2 -101, "Appointment, qualifications" of Article III, <br />Chapter 2 of the City of Casselberry Code of Ordinances is amended to read as follows: <br />Sec. 2 -101. - Appointment; qualifications. <br />(a) Appointment generally. The City Commission shall appoint a City Manager of the <br />City government pursuant to Article V, Section 2-3 5.01, of the City Charter, who shall serve as <br />the chief executive, administrative and enforcement officer of the City in accordance with the <br />City Charter, ordinances, resolutions, and rules and regulations established by the Commission <br />time to time. <br />
