Street B <br />Street .A (Main Street) <br />4. Material. All fences or walls shall be constructed from approved material <br />enumerated herein and shall be erected with the finished side facing out. Barbed wire <br />or similar materials shall not be allowed in any residential districts. <br />4: 5. Undeveloped properties. Undeveloped residential properties may be fenced upon <br />approval by the Administrative Official of the location and material type. <br />5 6. Non - compliant fences and walls. Legally existing non - compliant fences and walls on <br />residential properties may be replaced, restored, or reconstructed as originally <br />permitted. Such replacement, restoration, or reconstruction shall adhere to the current <br />permitting requirements expressed within this section. The burden of proof in <br />establishing the legal non - compliant status of an existing fence or wall rests solely with <br />the applicant, Those applicants who are unable to effectively prove such legal non- <br />compliance shall be subject to the current fence and wall regulations of this section. <br />7. Fence and wall locations. There shall only be one fence or one wall per perimeter, per <br />property. A new fence or wall shall not be erected directly adjacent to an existing fence <br />or wall on the same lot. <br />8. Appearance. Fences shall present a uniform appearance. Attachments to increase the <br />height or length of an existing fence shall be of the same material, color, and design as <br />the existing fence. <br />SECTION 2. APPLICABILITY. This Ordinance does not apply to existing fences that were <br />constructed with an approved City permit prior to the date of adoption. <br />SECTION 3. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Ordinance. <br />SECTION 4. CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be <br />made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this <br />Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may <br />be changed to "Section," "Article," or other appropriate word. <br />SECTION 5. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br />Ordinance 12 -1379 <br />Page 3 <br />
