WHEREAS, the City of Casselberry has been using SunGard Public Sector, Inc. Enterprise Resource Planning (ERP) software for financial and other applications since the late 1980's; and WHEREAS, SunGard Public Sector, Inc. is a sole source provider of the City's current ERP software; and WHEREAS, the City desires to expand software service to include Code Compliance and Human Resources modules; and WHEREAS, the City's current contract expires September 30, 2011; and WHEREAS, the City Finance Department has negotiated a contract to upgrade the City's current ERP software to SunGard Public Sector, Inc. latest software release. NOW THEREFORE, DE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement with SunGard Public Sector, Inc. (attached as "Exhibit A "), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. The City Commission hereby accepts the terms and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION V. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this k D of day of TL , A.D. 2011.
