("Progress Energy"), whose address is <br />Post Office Box 14042, St. Petersburg, Florida 33733, for itself and its successors and assigns, <br />�,.p <br />and in consideration of the sum of Ten and NO/I 10 Dollars ($10,00) and other good and valuable <br />consideration, the receipt and sufficiency of which Progress Energy hereby acknowledges, does <br />hereby grant, bargain, sell and convey to the CITY OF CASSELBERRY, a Florida municipal <br />corporation, whose mailing address is 95 Triplet Lake Drive, Casselberry, Florida 32707 <br />("Grantee"), its successors and assigns the non-exclusive and perpetual right, privilege and <br />easement solely for outdoor recreational purposes, including hiking, walking, skating, bicycling, <br />running, jogging and similar activities, on, upon, through, across and within the following <br />described lands situated in Seminole County, Florida (the "Easement Area"), to wit: <br />CC, <br />y.3 <br />See EXHIBIT "A", attached hereto and incorporated herein, and C <br />7- by this reference made a part hereof, said property consisting of a <br />portion of Tax Parcel 21-21-30-300-004A-0000 and a portion of E�l <br />(C) <br />Tax Parcel 21-21-30-300-004E-0000. " X: <br />TOGETHER WITH the right for Grantee to construct, install, utilize, inspect, maintain, <br />repair, rebuild, remove and protect a recreational trail (paved or unpaved) and related facilities for <br />such purposes, and to make such trail improvements available for use by Grantee, its lessees, <br />licensees and the general public, along with all other rights and privileges reasonably necessary <br />U) <br />for the safe use and maintenance of Grantee's trail improvements, including the right to install <br />sod, groundcover, mulch, gravel and other landscaping, and to trim, cut and keep clear trees, C? <br />CD <br />limbs and undergrowth within said Easement Area, all SUBJECT TO the following terms and C., <br />conditions: <br />1. Public access to and from the Easement Area, and the trail improvements therein, <br />shall be restricted to the adjoining portions of Grantee's trail. Nothing contained herein shall be <br />construed as a grant to Grantee, the general public, or any other person(s), of the right to enter <br />upon any part of Progress Energy's property outside of the Easement Area. The general public <br />shall use the Easement Area at their sole risk and expense, and all activities and use of the <br />Easement Area and the trail improvements therein by the general public shall be restricted to <br />Page I of 6 <br />
