RESOLUTION 11 -2240 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA APPROVING AND AUTHORIZING THE EXECUTION OF A SCOPE OF SERVICES AGREEMENT BETWEEN HDR ENGINEERING, INC. AND THE CITY OF CASSELBERRY FOR CONSTRUCTION ENGINEERING INSPECTION SERVICES FOR THE WIRZ TRAIL SECTION 1 PROJECT, PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, on January 24, 2011, via Resolution 11 -2223, the City Commission approved a Local Agency Program (LAP) Agreement with the Florida Department of Transportation (FDOT) for obtaining and providing financial reimbursement assistance to the City for construction costs of Wirz Trail Section 1; and WHEREAS, FDOT has submitted an amended LAP Agreement for the Wirz Trail Section 1 project which provides for the actual construction and CEI reimbursements costs of $1,284,158.00; and WHEREAS, FDOT has required that professional construction engineering inspection (CEI) services are necessary to ensure Wirz Trail Section 1 is constructed efficiently and effectively to the City's and FDOT's satisfaction; and WHEREAS, the City has a continuing services contract with HDR to provide professional transportation engineering services which includes CEI services; and WHEREAS, HDR Engineering, Inc. has provided a Scope of Services Agreement for CEI services for the Wirz Park Trail Section 1 project not to exceed $91,367.84, without prior authorization; and WHEREAS, City Staff has reviewed the Scope of Services Agreement for CEI services submitted by HDR Engineering, Inc. and found it adequate to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Scope of Services Agreement with HDR Engineering, Inc. for CEI Services for the Wirz Trail Section 1 project, attached as "Exhibit A "', and authorizes the Mayor to execute said document on behalf of the City. SECTION 1I. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
