RESOLUTION 11 -2221 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF CHANGE ORDER NO.2 TO THE AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND KILLEBREW, INC. FOR CONSTRUCTION OF ADDITIONAL WATER QUALITY IMPROVEMENT PROJECT AREAS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, in September 2009, the Florida Department of Environmental Protection (FDEP) awarded the City $3M in stimulus grant and loans related to the American Recovery and Reinvestment Act (ARRA) to cover the costs associated with the construction of water quality improvement project areas throughout the City's water distribution system; and WHEREAS, via Resolution 10 -2107, Killebrew, Inc. was selected under a competitively bid process to construct the City's water quality improvement project areas; and WHEREAS, via Resolution 10 -2111, the City Commission approved Change Order No. 1 with Killebrew, Inc. which added an additional project area to the list of approved project; and WHEREAS, FDEP recently notified the City that second round ARRA funding was available to further construct additional water quality improvement project areas; and WHEREAS, Public Works staff identified additional project areas throughout the City's potable water distribution system that could benefit from this ARRA funding and submitted said list of project areas to FDEP for consideration; and WHEREAS, FDEP approved the City's fundable list of project areas and subsequently awarded the City $3,076,923 in additional grant /loan funding which enables the City to fund the construction of the additional water quality improvement project areas; and WHEREAS, Killebrew, Inc. has submitted Change Order 2 in the amount of $2,726,923 (based on original contractual construction agreement line -item unit costs) to construct said additional water quality improvement project areas; and WHEREAS, City staff and City's technical consultant have reviewed Change Order No. 2 submitted by Killebrew, Inc. and found it adequate to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Change Order No. 2 to the agreement with Killebrew, Inc. for Casselberty's Water Quality Improvement Projects, attached as Exhibit "A ", and authorizes the Mayor to execute said document(s) on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
