ORDINANCE NO. 10 -1341 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA AMENDING <br />CHAPTER 94, WATERWAYS, ARTICLE I, IN GENERAL, TO CREATE SECTION 94- <br />12, "BOAT LAUNCHING ", OF THE CITY CODE OF ORDINANCES; PROVIDING <br />FOR THE RESTRICTION OF LAUNCHING MOTORIZED VESSELS FROM CITY <br />PARKS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission adopted Resolution 07 -1813 which effectively closed <br />motorized vessel access to the public boat ramps at North Lake Triplet and Middle Lake Triplet; <br />and <br />WHEREAS, the Parks Administrative Rules were amended to include Section 18, Boat <br />Launching, restricting the launching of motorized vessels from City parks; and <br />WHEREAS, the City of Casselberry wishes to amend its Code of Ordinances to directly <br />include reference to the restriction of launching motorized vessels from City parks; and <br />WHEREAS, the City Commission desires to amend Chapter 94, Waterways, Article I, In <br />General, to create Section 94 -12 of the City Code so as to codify this act; and <br />WHEREAS, words with double underlined type shall constitute the creation of Section <br />94 -12, Boat Launching, of the City Code of Ordinances. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA AS FOLLOWS: <br />SECTION 1. The City Code of Ordinances, Chapter 94, Waterways, Article I, In <br />General, Section 94 -12, Boat Launching, is hereby created and shall read as follows: <br />Sec, 94 -12, Boat Launching <br />Da City Boat ramps may not be used by motorboats or personal watercraft. <br />Motorboats include any boat powered by a mechanical engine. A personal watercraft <br />means a class A inboard vessel, as defined by the United States Coast Guard, which uses <br />an internal combustion engine. <br />-b <br />�- The boat ramps may be used by City officials or their agents as needed in <br />the interest of the public and shall include motorized use if or where appropriate. <br />oc With the exception of b, launching a motorboat from a City park is <br />prohibited. <br />
