WHEREAS, the City of Casselberry, the sole reclaimed water provider within the
<br />jurisdictional boundaries of the City, has limited reclaimed water resources, and unrestricted
<br />reclaimed water use would have a detrimental impact on the City's ability to serve all of its
<br />reclaimed water customers, as well as compromise the reclaimed water system's operational,
<br />disposal, and storage abilities; and
<br />WHEREAS, it is the desire of the City Commission of Casselberry to amend Sections
<br />86 -332, et seq., previously adopted in accordance with 40C- 2.042(2)(a) and (b), F.A.C.; and
<br />WHEREAS, the City Commission of Casselberry hereby finds and declares that the
<br />adoption of this ordinance is appropriate, and in the public interest of the citizens of this
<br />community; and
<br />WHEREAS, words with double underlined type shall constitute additions to the original
<br />text and strike through shall constitute deletions to the original text.
<br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA:
<br />SECTION 1, Chapter 86, Utilities, Division 2, Landscape Irrigation, Sections 86 -332
<br />through 86 -340, of the City Code of Ordinances, are hereby amended, and to new section 86 -341
<br />is added as follows:
<br />Sec. 86 -332. Legislative intent and purpose.
<br />It is the intent and purpose of this division to implement provisions, processes and
<br />procedures that promote water conservation through the more efficient use of
<br />landscape irrigation within the City of Casselberry.
<br />Sec. 86 -333. Definitions.
<br />Landscape irrigation means the outside watering of plants in a landscape such as
<br />shrubbery, trees, lawns, grass, ground covers, plants, vines, gardens and other
<br />such flora that are situated in such diverse locations as residential areas,
<br />m��es, public, commercial, and industrial establishments, and public medians
<br />and rights -of -way. "Landscape irrigation" does not include agricultural crops .
<br />nursery plants. cemeteries. golf course greens, tees, fairways, primary troughs, and
<br />vegetation associated with intensive recreational areas such as, bt4 r^ *':fflite +^,
<br />playgrounds, and football, baseball and soccer fields.
<br />Non - residential landscape irrigation means the irrigation of landscape not
<br />included within the definition of "residential landscape irrigation." such as that
<br />associated with public, commercial and industrial property, including commercial
<br />or transient housing units, hotel and motel units, and public medians and rights -
<br />of_way.
