10-1315 Amending Capital Improvement Element of Comp Plan

WHEREAS, the Florida Legislature intends that local planning be a continuous and on- going process; and WHEREAS, the Growth Management legislation, F.S. 163.3177(3), requires an annual update to the Five -Year Capital Improvement Schedule (CIS) in the Capital Improvements Element (CIE); and WHEREAS, the annual update amendment to the Capital Improvement Element is exempt from the twice per year limitation on plan amendment adoptions pursuant to s. 163.3187(1)(0, F.S.; and WHEREAS, the Planning and Zoning Board acting as the designated Local Planning Agency, reviewed the Comprehensive Plan Amendment on January 27, 2010, held an advertised public hearing, provided for participation by the public in the process, and rendered its recommendations to the City Commission; and WHEREAS, The City Commission, on March 22, 2010, held an advertised public hearing and second reading for the proposed Ordinance, providing for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF T OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission does hereby adopt the "Five Year Capital Improvement Schedule 2010 — 2014" into the City of Casselberry's Comprehensive Plan, attached hereto as Exhibit "A ", and incorporated by reference. SECTION 2. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed.
