ORDINANCE 13 -1390 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF MAJOR THROUGHFARE MIXED USE FOR THE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; AMENDING TEXT IN FLU POLICY 1.22, MAJOR THOROUGHFARE MIXED USE; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, the properties described in Section I are within the corporate boundary of the City of Casselberry; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and WHEREAS, properties provided in Section 1 of this ordinance are less than 10 acres, requiring a small scale amendment to the Comprehensive Plan; and WHEREAS, Comprehensive Plan text may be amended in support of a future land use map amendment; and WHEREAS, the mixed use requirement within FLU 1.22 of the Comprehensive Plan requires clarification; and WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of small scale comprehensive plan amendments including amendments to the Future Land Use (FLU) map; and WHEREAS, the Casselberry Planning and Zoning Commission /Local Planning Agency has held a public hearing with due public notice to consider this future land use map amendment; and WHEREAS, the City Commission of the City of Casselberry, Florida, held a public hearing with due public notice to consider the future land use map amendment and has determined that the future land use designation of said property provided in Section I, herein, shall be established as Major Thoroughfare Mixed Use, as that classification is defined in Articles IV and V of Chapter Il, as amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida; and WHEREAS, with double underlined type shall constitute additions to the original text and &4ke t shall constitute deletions to the original text NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That the Official Future Land Use Map as established in the Future Land Use Element of the Comprehensive Plan of the City of Casselberry, Florida, as amended and supplemented, for the subject properties, is hereby amended by changing the designation of approximately 5 acres of property to the MTMU (Major Thoroughfare Mixed Use) future land use designation as that classification is defined in
