ORDINANCE 13 -1390 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND <br />THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE <br />DESIGNATION OF MAJOR THROUGHFARE MIXED USE FOR THE PARCELS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; AMENDING TEXT IN FLU <br />POLICY 1.22, MAJOR THOROUGHFARE MIXED USE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. <br />WHEREAS, the properties described in Section I are within the corporate boundary of the City of <br />Casselberry; and <br />WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for <br />the most appropriate future development of the site; and <br />WHEREAS, properties provided in Section 1 of this ordinance are less than 10 acres, requiring a <br />small scale amendment to the Comprehensive Plan; and <br />WHEREAS, Comprehensive Plan text may be amended in support of a future land use map <br />amendment; and <br />WHEREAS, the mixed use requirement within FLU 1.22 of the Comprehensive Plan requires <br />clarification; and <br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of small scale <br />comprehensive plan amendments including amendments to the Future Land Use (FLU) map; and <br />WHEREAS, the Casselberry Planning and Zoning Commission /Local Planning Agency has held a <br />public hearing with due public notice to consider this future land use map amendment; and <br />WHEREAS, the City Commission of the City of Casselberry, Florida, held a public hearing with due <br />public notice to consider the future land use map amendment and has determined that the future land use <br />designation of said property provided in Section I, herein, shall be established as Major Thoroughfare Mixed <br />Use, as that classification is defined in Articles IV and V of Chapter Il, as amended and supplemented, of <br />the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida; and <br />WHEREAS, with double underlined type shall constitute additions to the original text and &4ke <br />t shall constitute deletions to the original text <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That the Official Future Land Use Map as established in the Future Land Use <br />Element of the Comprehensive Plan of the City of Casselberry, Florida, as amended and supplemented, for <br />the subject properties, is hereby amended by changing the designation of approximately 5 acres of property <br />to the MTMU (Major Thoroughfare Mixed Use) future land use designation as that classification is defined in <br />
