b. Locations with retail sales of alcohol for solely off -site consumption (such as convenience <br />stores, package stores, gas stations and the like) are exempt from meeting distance <br />separations. <br />c. A restaurant holding a 2COP alcoholic beverage license that derives at least 51 percent of <br />gross revenue from the sale of food and nonalcoholic beverages is exempt from meeting <br />distance separations. <br />(2) Method of measurement. This distance shall be measured, without regard to municipal <br />boundaries, following the shortest route of ordinary pedestrian travel from the main entry of the <br />licensee's establishment, continuing along the pedestrian walkway provided on the licensee's <br />property to a public thoroughfare, and then continuing along the public thoroughfare to one of the <br />following sites: <br />a. Church or other places of worship: the nearest point of the main building, sanctuary, or <br />meeting hall, where services are conducted. <br />b. Educational institution: the nearest building on the school grounds. <br />c. Bar, lounge, or bottle club: the primary entrance to such establishment <br />SECTION 3: CODIFICATION. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the <br />Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered <br />or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or <br />other appropriate word. <br />SECTION 4. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any <br />other Section or part of this Ordinance. <br />SECTION 5: CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions <br />of this Ordinance are hereby repealed. <br />ATTEST: <br />onna G.
