6. Waivers for dead trees on undeveloped commercial properties, excluding trees that have been <br />intentionally damaged. A waiver may be requested to exclude diseased, distressed or dead trees on <br />undeveloped commercial properties from replacement requirements. The waiver request shall include a <br />detailed analysis by a registered landscape architect or certified arborist itemizing the tree(sl, species <br />DBH. condition, and location and explaining the reason for the proposed exclusion. The waiver may be <br />granted by staff upon review of a tree removal permit application. Such trees may receive a full, partial <br />or pro -rated waiver based upon the condition of the tree. No waivers based upon tree quality shall be <br />considered for trees which have been illegally damaged or removed without a tree removal permit. <br />SECTION 3: CODIFICATION. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the <br />Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered <br />or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or <br />other appropriate word. <br />SECTION 4. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any <br />other Section or part of this Ordinance. <br />SECTION 5: CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions <br />of this Ordinance are hereby repealed. <br />SECTION 6: EFFECTIVE DATE.
