Planning & Zoning Commission/ <br />Local Planning Agency <br />September 12, 2012 <br />Page 5 <br />Commission's findings of fact and conclusions, the staff report dated September 12, 2012, the property survey <br />(Exhibit B), and the following conditions: <br />1. The fence shall not exceed six feet and shall not be enlarged in any way. <br />2. The fence shall be maintained in good repair and the good side must face out. <br />3. The fence shall only be allowed 9 feet in the front yard adjacent to North Winter Park Drive and will be <br />located no closer to Camelot Way than between the door and the window of the house as indicated in the <br />staff report. <br />4. The fence shall not create a visibility obstruction for traffic. <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />A brief discussion ensued regarding the fence located at the rear of the adjacent property, the location of the <br />proposed fence and similar fences on Winter Park Drive. <br />Mr. Meadows asked the applicant to come forward. Mrs. Hirmina Fernandez, 1006 Camelot Way, <br />Casselberry, Florida came forward. Mrs. Fernandez said she requested the fence due to her husband's health <br />issues. She said her husband likes to spend time outdoors and the school children go on her patio and make fun of <br />her husband. She said they are also destroying her plants. <br />In response to the Commission's question regarding reducing the variance request to 9 feet, Ms. Fernandez <br />said she wanted the full variance due to the children taking the fruit from the trees and destroying her plants. Mrs. <br />Fernandez said that she has lived in her home for 35 years and never asked for anything. She said that her <br />neighbors that live across the street from her home have only lived there a few years and they have a fence. A brief <br />discussion ensued regarding the distance from the small temporary fence in her yard to the house. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. Maurice Jenkins, 1030 Camelot Way, Casselberry, Florida came forward. Mr. Jenkins said his <br />home is adjacent to Ms. Fernandez's home. He said he didn't have an objection to the fence located along Winter <br />Park Drive. A brief discussion ensued regarding the proposed fenced area. <br />Mr. Meadows asked for final comments from the applicant and staff. There were no final comments. <br />A discussion ensued regarding the location of the existing temporary fence on the property, possible options <br />for the proposed fence and the criteria required for granting a variance. The Board considered continuing this item to <br />the October meeting to allow staff to provide additional measurements. <br />
