Mr. Kevin Frye and Mrs. Karen Frye, 203 Hoffman Court, <br />Casselberry, Florida came forward. Mr. Frye estimated the height of the subdivision wall to be 57'. <br />Mrs. Frye addressed the following variance criteria: <br />Criteria 1. Existence of special conditions or circumstances: Mrs. Frye stated that the staff report states the variance <br />is requested for privacy. She stated that the variance was requested for privacy but also requested for security, functionability <br />and full use of their property. She said their home sat vacant for approximately 1 %2 years and during that time the home was <br />vandalized and behind the subdivision wall located in the rear corner of the yard there was drug paraphernalia, empty alcohol <br />bottles and clothing. She said they are concerned about vandalism and security. <br />Criteria 2. Conditions not created by the applicant. Mrs. Frye said that their home is a corner lot at the entrance of <br />Colonial Point Subdivision. She said their property abuts three roads and their house is extremely exposed. Mrs. Frye said <br />the bus stop is located adjacent to their property and there is a significant amount of foot traffic in their immediate area. <br />Criteria 4. A hardship condition exists. Mrs. Frye said there is more of an issue of security, functionability, privacy <br />and full use of their property. Mrs. Frye said they would feel more secured if that portion of the yard was fenced. <br />Criteria 5. Only the minimum variance granted. Mrs. Frye said they would abide by the Planning and Zoning <br />Commission decisions on the placement of the fence. <br />She said their intention is to secure their property boundaries without negatively impacting the aesthetic appearance <br />of their property. Mrs. Frye said that the type of fencing was discussed with staff and staff recommended a 6 foot vinyl fence. <br />Mrs. Frye felt that granting the variance would not negatively impact the community. <br />A general discussion ensued regarding security issues with the subdivision wall, the proposed fence, the subdivision <br />wall and possible liability issues. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Ms. Tanya Coutant, President of Homeowners' Association, 210 Hoffman Court, Casselberry, Florida came forward <br />to speak in favor of the variance request. Ms. Coutant said it is a voluntary homeowners' association and the residents <br />volunteer to maintain the subdivision walls. She said the house had been vandalized several times before the Frye family <br />
