ORDINANCE 13 -1392 AN ORDINANCE OF THE . CITY OF CASSELBERRY, FLORIDA, REPEALING SECTION 86- 68(F), RECOVERY OF CAPACITY, CHAPTER 86, UTILITIES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the City Commission deems it in the best interest of the City to repeal Section 86 -68(f) from the City Code, since the City considers it to be inequitable to charge subsequent owners a benefit fee when prior owners have already paid said fee. NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, Florida: SECTION 1. Section 86- 68(f), Recovery of capacity, of Chapter 86, Utilities, is hereby repealed as follows: 1 111 All I SECTION 2 - CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. SECTION 3 - CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION 4 - SEVERABILITY. If any Section, or portion of a Section of this Ordinance is of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other Section or part of this Ordinance. SECTION 5 - EFFECTIVE DATE. This Ordinance shall become effective immediately upon its passage and adoption. FIRST READING this day of r- , A.D. 2013.
