Finance Director <br />Dandy Newlon reported that the City Commission had advised that they were willing to entertain <br />benefit enhancements if connected to a Stop Restart Ordinance. The City Commission expects <br />that through collective bargaining the unions and the City will work out what that will be. In the <br />meantime a separate ordinance is needed to implement IRS and State required plan revisions. <br />MOTION: �� Moved by Daniel Glancy to direct Scott <br />ordinance o include only IRS and other ad and <br />excluding pending benefit enhancements. Motion was seconded by Matthew <br />Hettler and carried on a 3 — 1 voice vote with William Nas dissenting. <br />Once the Administrative ordinance is passed Scott Christiansen is authorized to complete the <br />Summary Plan description. <br />10 Miscellaneous <br />Jered Ding was acknowledged as new member of the plan. <br />WA r 4 • <br />It was acknowledged that a benefit enhancement status update was provided during the attorney <br />report. Further discussion ensued. Firefighter trustee Matthew Hettler observed that the <br />Firefighter union contract was in negotiations now and asked if the benefit enhancements would <br />have to be agreed to with the current contract. Finance Director Randy Newlon responded that <br />benefit enhancements could be bargained independent of the overall contract but that there would <br />need to be some kind of agreement reached to accept a Stop Restart ordinance along with some <br />other benefit enhancement. <br />Attorney Scott Christiansen confirmed that the unions (Police and Fire) would have to approve <br />the change in the use of State money via a Stop Restart Ordinance. If it were a change in the <br />required contribution of members then the membership would have to vote on it. Once the <br />unions approve the Stop Restart Ordinance the City can move forward and consider benefit <br />enhancements already approved by the membership. <br />William Nas asked if any pension plan had gone to court to require a City to use the State money <br />as the legislature intended? Scott Christiansen answered that the City does not have to use the <br />State money if it chooses but that the City risks not getting the State money any more if it doesn't. <br />Since 1999 no City has lost its State money but there have been some that have received letters <br />warning that if benefit enhancement are not implemented that State money could be denied. A <br />letter from the State may be triggered by receipt of a letter from a union to Patricia Shoemaker <br />complaining of inaction. <br />12. New Business <br />Trustee Matthew Hettler asked if he could be authorized to go to the State Conference in May, <br />2010. <br />
