RESOLUTION 13 -2479 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF <br />SUPPLEMENTAL AGREEMENT NO. 40 TO THE CONTINUING SERVICES <br />AGREEMENT WITH CPH, INC. FOR WETLAND MITIGATION SERVICES FOR THE <br />NORTH WINTER PARK DRIVE PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the St. Johns River Water Management District permit for North Winter Park Drive (from <br />Seminola Boulevard to State Road 434) contained wetland mitigation requirements associated with a dedicated <br />conservation area; and <br />WHEREAS, said conservation area has not satisfactorily achieve the aforesaid mitigation requirements, and <br />additional corrective actions are needed; and <br />WHEREAS, the City of Casselberry has a continuing services agreement with CPH, Inc. (CPH); and <br />WHEREAS, CPH has submitted Supplemental Agreement No. 40 (in an amount not to exceed $11,250) to <br />assist with additional mitigation services; and <br />WHEREAS, Public Works staff has reviewed Supplemental Agreement No. 40 submitted by CPH, Inc. and <br />finds it sufficient to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental Agreement <br />No. 40 to Continuing Consulting Engineering Services agreement with CPH, Inc., for an amount not to exceed <br />$11,250, and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br />SECTION IV.
