AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING
<br />CHAPTER 86, UTILITIES, ARTICLE II, SEWER, DIVISION 3, SECTION 86 -72,
<br />SCHEDULE OF RATES AND CHARGES, AND ARTICLE III, WATER,
<br />DIVISION 2, SECTION 86 -189, SCHEDULE OF RATES AND CHARGES, OF
<br />THE CITY CODE OF ORDINANCES; CORRECTING A SCRIVENER'S ERROR
<br />CONTAINED IN ORDINANCE 12 -1382 ADOPTED ON NOVEMBER 13, 2012,
<br />TO REVISE WORDING IN SOME OF THE NEW SEWER, RECLAIMED
<br />WATER AND WATER FEES AND CHARGES TABLES TO STATE
<br />"REFLECTS THE CHARGE PER 1,000 GALLONS "; PROVIDING FOR
<br />CONFLICTS, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE.
<br />WHEREAS, the City Commission found it necessary to establish new sewer,
<br />reclaimed water and water rates to continue to provide for the health, safety, and general
<br />welfare of the sewer, reclaimed water and water customers of the City of Casselberry and
<br />duly adopted Ordinance 12 -1382 on November 13, 2012; and
<br />WHEREAS, a scrivener's error was detected after adoption of Ordinance 12-
<br />1382, specifically that the phrase "reflects the charge per 1,000 gallons" was omitted
<br />from some of the new sewer, reclaimed water and water fees and charges tables presented
<br />as Attachment A to Ordinance 12 -1382; and
<br />WHEREAS, the City Commission finds it necessary to correct the scrivener's
<br />error for the new rates to be effective January 1, 2013, retroactively; and
<br />WHEREAS, words with double underlined type shall constitute additions to the
<br />original text and strike through shall constitute deletions to the original text, and asterisks
<br />(* * *) indicate that text shall remain unchanged from the language existing prior to
<br />adoption of this Ordinance.
<br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. That Article Il, Sewers, Division 3, Section 86 -72, Schedule of
<br />rates and charges, be amended to delete all references of "[ *] Reflects the charges
<br />effective January 1St of Fiscal Year 2013 and October 1st of each subsequent Fiscal Year."
<br />and insert the following language: [ *] Reflects the charge per 1,000 gallons effective
<br />January 1St of Fiscal Year 2013 and October 1st of each subsequent Fiscal Year," as
<br />shown on attached Exhibit "A ".
<br />SECTION II. That Article III, Water, Division 2, Section 86 -189, Schedule of
<br />rates and charges, be amended to delete all references of "[ *] Reflects the charges
<br />effective January 1st of Fiscal Year 2013 and October 1St of each subsequent Fiscal Year."
<br />and insert the following language: [ *] Reflects the charge per 1,000 gallons effective
