Appeal of Conditional Use Conditions — Fifi's Grooming School and Veterinary <br />Clinic, CU 12 -08 <br />Notice ofPablicHearing: The Notice of Public Hearing relative to Appeal of Conditional Use Conditions - <br />Fifi's Grooming School and Veterinary Clinic, CU 12 -08, was published in the Orlando Sentinel on September <br />13, 2012. <br />Budget Lnpact: There is no impact to the City budget. <br />Recommendation: The City Manager and the Community Development Director recommended the City <br />Commission review and discuss the appeal. Should the City Commission decide to amend the conditions of <br />the Planning and Zoning Commission approval, staffed recommended the following conditions: <br />#3 There shall be no outdoor play areas or outdoor kennels for the animals. Outdoor walking of <br />the animals by customers and staff should be as needed and minimal. <br />#4 The owner /operator of Fill's Grooming School and Veterinary Clinic shall be responsible for <br />the removal of all animal feces from the outdoor grounds of the plaza located at 497 SR 436. Regular removal <br />of feces collected indoors and outdoor shall be scheduled to ensure there are no odor impacts to the adjacent <br />tenants. <br />Staff Presentation: Development Services Manager Sandra Smith gave an overview ofthe item, explaining <br />that the applicant for a conditional use at Fifi's Grooming School and Veterinary Clinic located at 497 State <br />Road 436 was appealing a decision made by the Planning and Zoning Commission. She finther explained that <br />the appeal requirements provided that Commission's review ofthe appeal was to be based on the record ofthe <br />Planning and Zoning Commission meeting. She added that although the applicant had been provided the <br />opportunity to have a verbatim transcript of the meeting prepared for Commission review, they had not done <br />so; therefore, the Commission was being provided with the staff report and the staff generated minutes for <br />review. <br />Ms. Smith provided a PowerPoint presentation to assist the Commission in reviewing the appeal. A copy of <br />the PowerPoint presentation is attached to and made a part of these minutes. <br />Ms. Smith explained that the conditionaluse had been approved bythe Planning and Zoning Commission with <br />nine conditions, and the applicant was appealing conditions 43 and #4, which were as follows: <br />#3 There shall be no outside walking of animals by staff of students. Nor will there be any <br />outside play areas for animals. The walking of animals by customers in the rear of the <br />building will be discouraged. <br />44 Animal feces outside shall be collected and disposed of accordingly on at least a daily basis. <br />
