number of events or days for a special event, open air sale, or open-air food sale set forth <br />in Section 14 -42, the property owner may petition the City Commission for permission to <br />exceed the restriction. Such petition shall be in the form of a letter from the property owner <br />explaining why exceeding the code limitation is necessary, and why it will not be a burden <br />on the general public or on the surroundina property. <br />The City Commission shall grant permission after verification that the event meets the <br />standards for issuance of a permit under 14 -29, and after a finding that permitting the <br />additional event is in the public interest, and will not be a burden on the general public or <br />he surrounding property. <br />SECTION 4: Part II, Code of Ordinances, Chapter 14, Amusements, Article 11, Special <br />Event, Open Air Sales, Open Air Food Sales, Seasonal Sales, and Temporary Structures, Division <br />2, Special Events, Section 14- 42(a), Performance Criteria, shall be amended as follows: <br />Section 14-42 Performance criteria. <br />a) The maximum number of special events per developed site or parcel during a one - <br />year period is four. Open air sales; performance criteria. <br />(a) Open air sales, other than approved seasonal sales, shall be permitted only as an accessory <br />use to a permanent commercial building with a valid occupational license. No outdoor sales <br />shall be permitted as a temporary use which is not accessory to a permanent building. <br />(b) Open air sales shall be permitted only on properties zoned CG, CS, CL, PMX -L, PMX -H and <br />PS. No open air sales shall be permitted on properties zoned for residential or industrial use. <br />The City Manager or their designee shall determine those open air sales that may be <br />conducted on properties zoned ROS, whether developed or undeveloped, that are _of a public <br />interest and will not be a burden on the general public or the surroundina property. <br />SECTION 6.
