ORDINANCE 11 -1344 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />PERTAINING TO "CASH ONLY PHARMACIES" AND "PAIN <br />MANAGEMENT CLINICS ", IMPOSING A TEMPORARY MORATORIUM ON <br />THE ISSUANCE OF DEVELOPMENT PERMITS AND BUSINESS TAX <br />RECEIPTS FOR THE OPERATION OF "CASH ONLY PHARMACIES" AND <br />"PAIN MANAGEMENT CLINICS" IN THE CITY OF CASSELBERRY FOR A <br />PERIOD OF ONE YEAR (365) DAYS; SETTING FORTH FINDINGS, <br />PURPOSE, AND DECLARATION; PROVIDING FOR DEFINITIONS OF <br />"CASH ONLY PHARMACIES" AND "PAIN MANAGEMENT CLINICS "; <br />PROVIDING FOR EXEMPTIONS; PROVIDING NOTICE WAIVED; <br />PROVIDING A SUNSET PROVISION; PROVIDING FOR SEVERABILITY, <br />CONFLICTS; AND EFFECTIVE DATE. <br />WHEREAS, the Casselberry's Chief of Police and the Metropolitan Bureau of Investigation for the Ninth <br />Judicial Circuit have advised the City of Casselberry Commissioners that a pattern of illegal drug use and <br />distribution has been linked in large part to certain pain management clinics operating within the State of Florida; <br />and <br />WHEREAS, there has been a recent proliferation of Cash Only Pharmacies and Pain Management <br />Clinics within the Central Florida area; and <br />WHEREAS, the City does not currently regulate Cash Only Pharmacies or Pain Management Clinics; <br />and <br />WHEREAS, the Florida Legislature has identified concerns regarding the increased use and abuse of <br />substances controlled by federal and/or state law and the frequency of injury and death occurring as a result of <br />the increased availability of controlled substances via medical practitioners operating in pain management clinics <br />or facilities; and <br />WHEREAS, Florida Statutes require physicians and other persons dispensing prescription drugs <br />through pain management clinics, facilities, pharmacies or offices, to register with the State Department of <br />Health in order to conduct such business; and <br />WHEREAS, several counties and municipalities in Florida have established moratoria on certain new <br />pain management clinics and cash only pharmacies to curb the immediate negative impacts created by these <br />clinics and pharmacies such as illegal prescription drug trafficking and sales of illegal drugs around the clinics <br />and pharmacies, and loitering in areas surrounding these uses; and <br />
