(g) At the conclusion of the Public Hearing and after reviewing the evidence and <br />testimony placed before it, the City Commission shall act upon the request either to <br />approve, deny, or approve in part and deny in part the request made by the applicant. <br />SECTION 6. PENALTIES. <br />(a) Any person, firm, corporation or agent who shall violate any provision of this <br />Ordinance or who fails to comply therewith, or with any of the requirements thereof, shall <br />be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned for a <br />period not exceeding sixty (60) days. Either or both penalties may be imposed. Each day <br />during which any violation occurs constitutes a separate offense. <br />(b) Nothing herein contained shall prevent the City from taking such other lawful <br />action including, but not limited to, equitable legal action, as it deems necessary to prevent <br />or remedy any violation of this Ordinance. <br />SECTION 7. SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to <br />invalidate or impair the validity, force, or effect of any other Section or part of this <br />Ordinance. <br />SECTION 8. CONFLICTS. This ordinance shall stand repealed as of 12:01 a.m. on <br />September 21, 2012, unless sooner repealed; provided, however, nothing herein shall <br />prevent the re- adoption or ratification of this Ordinance in the same or similar form. <br />SECTION 9. EFFECTIVE DATE.
