3. In the event that the property owner fails or refuses to pay the said certified sum, a lien or a special <br />non -ad valorem assessment shall be made upon the property, which shall be payable with interest <br />at the highest lawful rate of interest per annum from the date of such certification until paid. <br />4. Such lien or special non -ad valorem assessment shall be enforceable in the same manner as a <br />iudgment or tax lien in favor of the City of Casselberry, and shall constitute a first priority <br />assessment lien against the affected property. superior to all liens except for any lien for taxes. and <br />may be satisfied at any time by payment thereof including, but not limited to, an_ y and all accrued <br />interest. Notice of such lien shall be filed by the City in the public records (land recordsl of <br />Seminole County, Florida. <br />5. If the subject property is secured by locks or otherwise. the City shall have the authority to enter <br />said property for purposes of remedying the condition causing the nuisance or violation. and any <br />additional costs incurred by the City in gaining access to the property, including, but not limited to. <br />judicial action, or in re- securing the property after cleaning and clearing, shall be considered <br />expenses of remedying the condition. <br />F. Administrative charges: administrative penalties. <br />1. In addition to the actual cost of remedying the nuisance cited under this division. the City shall also <br />assess a charge to cover the administrative expenses incurred by the City in securing and <br />monitoring the property, including the costs for the services of a private contractor or the City's <br />forces to remedy the nuisance. <br />2. The schedule of said administrative charges shall be reviewed and approved by City Manager or <br />designee at least on an annual basis. <br />3. If a second violation of this part of this division is cited against the same property and property <br />owner within 12 months from the date of the first citation, an administrative penalty of $100.00 shall <br />additionally be assessed by the City five days after the second citation. If the condition is abated by <br />the owner during the five -day period, the penalty will not be assessed. If a third violation of this part <br />of this division is cited against the same property and property owner within 12 months from the <br />date of the first citation, an administrative penalty of $200.00 shall additionally be assessed by the <br />City five days after the third citation. If the condition is abated by the owner during the five day <br />period, the penalty will not be assessed. Subsequent violations cited against the same property <br />and property owner may be referred to the City Attorney for appropriate legal action, including, but <br />not limited to, injunctive relief, in addition to enforcement as provided in this division. <br />G. Provisions of ordinance supplemental means_ of code enforcement. The provisions of this division <br />are additional and supplemental means of enforcing the City's Codes, and may be used for the <br />enforcement of all codes and ordinances duly adopted by the City Commission Nothing contained in <br />this division shall prohibit the City from enforcing its codes or ordinances by other means set forth in <br />the City's codes, provided in the statutory law of the State of Florida. or otherwise available to the Citv. <br />SECTION 4. The Code of Ordinances of the City of Casselberry, Florida, Part III, Unified Land <br />Development Regulations, Chapter III, "Performance Criteria ", Article X, "Appearance, Design and <br />Compatibility ", Section 3 -10.3, "Minimum maintenance standards and guidelines ", is hereby amended to <br />read as follows: <br />Section 3 -10.3. - Minimum maintenance standards and guidelines. <br />C.
