Resolution 12 -2380 — State Highway Lighting, Maintenance, and Compensation <br />Agreement with the Florida Department of Transportation <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND <br />AUTHORIZING THE EXECUTION OF A STATE HIGHWAY LIGHTING, MAINTENANCE, AND <br />COMPENSATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION <br />FOR THE LIGHTING MAINTENANCE ON U.S. HIGHWAY 17 -92 AND SR 436; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Introduction: Resolution 12 -2380 provides for consideration of a State Highway Lighting, Maintenance, and <br />Compensation Agreement Work Order with the Florida Department of Transportation (FDOT) for City <br />maintenance of street lights on U.S. Highway 17 -92 and S.R. 436 for Fiscal Year 2012/2013 for which the City <br />will be compensated $41,003.41. <br />Budget Impact: The compensation amount will be included in the adopted budget for FY 2013 and will be <br />programmed into the Streetlight Fund. <br />Recommendation: The Interim City Manager and the Public Works Director recommended approval of <br />Resolution 12 -2380. <br />D. Resolution 12 -23 81— Settlement Agreement & Release with John Deere Landscapes, <br />Inc. <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN JOHN DEERE LANDSCAPES, <br />INC., AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFCTIVE DATE." <br />Introduction: Resolution 12 -2381 provides for consideration of a Settlement Agreement & Release with John <br />Deer Landscapes, Inc. in the amount of $50,000, which is a result of the ongoing litigation between the City of <br />Casselberry and Garden World of Holiday, Inc., general contractor for the intersection median improvements <br />project on U.S. Highway 17 -92, Project No. 0801. <br />Discussion: The City's insurer, The Florida League of Cities, has agreed to pay the settlement amount of <br />$50,000 in full. Approval of the settlement agreement will bring this litigation to a close. <br />Budget Impact: There is no impact to the City Budget. The settlement payment of $50,000 will be made by <br />the Florida League of Cities. <br />Recommendation: The Interim City Manager and the City Attorney recommended approval of Resolution <br />12 -2381. <br />
