Board of Adjustment
August 25, 2011
Page 3
5. The arches are installed upon the roof and roof signage is prohibited by the City Code.
He said Staff recommends that the Board of Adjustment uphold the determination of the Administrative Official.
In response to the Board's question regarding the lighting issue, Mr. Raasch said he was not privyto the lighting
discussion. He noted that there are other options to provide lighting on the structure other than the arches.
Mr. Guzman asked the applicant to come forward, Ms. Murphy said that she has been doing construction for 38
years and codes are developed in order to better things for the people in the community and all codes are subject to
application depending on the situation. Ms. Murphy agreed there are other means of lighting but was concerned that
other types of lighting would not compliment the building. She said their intent is to keep it more harmonious. Ms.
Murphy said from their standpoint there is nothing obtrusive about the design and they have never received any
complaints from the community regarding the design, She said that LED lighting would be used and it is not offensive in
the overall design.
In response to the Board's question regarding any denials from other municipalities, Mr. Murphy said that
Clearwater, Florida denied the installation of the arches.
Mr. Guzman asked if there was anyone in the audience who wished to speak in favor or against this request.
No one came forward.
A brief discussion ensued regarding the lighting of the arches in the appeal process. Mr. Guzman asked for a
motion for BA 11-06. Mr. McMullen made a motion to deny BA 11-06 for the appeal of the Administrative Determination
for Taco Bell signage. Mr. Weinroth seconded the motion. Mr. McMullen amended his motion to uphold the
Administrative Determination for Taco Bell signage for BA 11-06. Ms. Wallace seconded the motion. The motion passed
unanimously by voice vote.
Sixth Item of Business: Other Business
There was no other business for the Board.
Seventh Item of Business: Adjournment
There being no further business to come before the Board, motion was made, seconded and passed to adjourn.
DATE MINUTES APPROVED BY BOARD OF ADJUSTMENT:
a;
Joni Dixon, Secretary
