The arches are installed upon the roof and roof signage is prohibited by the City Code. <br />He said Staff recommends that the Board of Adjustment uphold the determination of the Administrative Official. <br />In response to the Board's question regarding the lighting issue, Mr. Raasch said he was not privyto the lighting <br />discussion. He noted that there are other options to provide lighting on the structure other than the arches. <br />Mr. Guzman asked the applicant to come forward, Ms. Murphy said that she has been doing construction for 38 <br />years and codes are developed in order to better things for the people in the community and all codes are subject to <br />application depending on the situation. Ms. Murphy agreed there are other means of lighting but was concerned that <br />other types of lighting would not compliment the building. She said their intent is to keep it more harmonious. Ms. <br />Murphy said from their standpoint there is nothing obtrusive about the design and they have never received any <br />complaints from the community regarding the design, She said that LED lighting would be used and it is not offensive in <br />the overall design. <br />In response to the Board's question regarding any denials from other municipalities, Mr. Murphy said that <br />Clearwater, Florida denied the installation of the arches. <br />Mr. Guzman asked if there was anyone in the audience who wished to speak in favor or against this request. <br />No one came forward. <br />A brief discussion ensued regarding the lighting of the arches in the appeal process. Mr. Guzman asked for a <br />motion for BA 11-06. Mr. McMullen made a motion to deny BA 11-06 for the appeal of the Administrative Determination <br />for Taco Bell signage. Mr. Weinroth seconded the motion. Mr. McMullen amended his motion to uphold the <br />Administrative Determination for Taco Bell signage for BA 11-06. Ms. Wallace seconded the motion.
