<br />WHEREAS, a public hearing has been duly held on August 22, 2011 and <br />comments and objections of all interested persons have been heard and <br />considered as required by the terms of the Ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. AUTHORITY. This Annual Rate Resolution is adopted <br />pursuant to the Master Capital Project and Service Assessment Ordinance <br />(Ordinance 09-1301), the Initial Assessment Resolution (Resolution 09-2062), as <br />amended, the Final Assessment Resolution (Resolution 09-2078), the <br />Preliminary Rate Resolution (Resolution 11-2285), Chapter 166, Florida Statutes, <br />Article VIII, Section 2, Florida Constitution, and other applicable provisions of law. <br />SECTION 2. DEFINITIONS. This resolution is the Annual Rate <br />Resolution as defined in the Ordinance. All capitalized terms in this Annual Rate <br />Resolution shall have the meanings defined in the Ordinance, Initial Assessment <br />Resolution, as amended, the Final Assessment Resolution, and the Preliminary <br />Rate Resolution (Resolution 11-2285). <br />SECTION 3. CONFIRMATION OF PRELIMINARY RATE RESOLUTION. <br />The Preliminary Rate Resolution is hereby ratified and confirmed. <br />SECTION 4. APPROVAL OF ASSESSMENT ROLL. The updated Street <br />Lighting Assessment Roll, which is currently on file in the office of the City <br />Manager is hereby approved. <br /> <br />3 <br />
