b. All deteriorated or damaged structural and decorative fences or walls, or portions of fences <br />and walls, shall be repaired or replaced to match as closely as possible with the existing or <br />original materials and construction of the fence or wall. Rotten or weakened portions shall <br />be removed, repaired or replaced in such a manner as to be compatible with the rest of the <br />fence or wall or to match the original materials and construction techniques. All exposed <br />wood shall be stained or painted, except wood that is generally recognized to withstand <br />outdoor exposure without such treatment. Every such part shall be clean of graffiti, litter, <br />dirt, mildew or other debris; and where surfaces are painted, once painted or normally <br />painted, not more than ten percent (10%) of such surface may be free of paint; painted <br />surfaces shall be maintained without peeling or chalking. <br />3. VACANT AND DEVELOPED SITES <br />a. Landscaping: All green areas (front, side and rear yards) shall be kept free of overgrowth, <br />weeds, trash and debris. All dead tree limbs and dead trees shall be removed. <br />b. Parking Lots: Parking areas shall be well maintained and kept free of overgrowth, <br />potholes, weeds, trash and debris. Paving, striping, and traffic control signs and pavement <br />markings shall be maintained in good repair and in a neat and clean appearance. <br />c. Site Maintenance Obligation: The owners and successors of property developed under an <br />approved site plan shall not remove, destroy, modify subvert or render inoperable, through <br />act or omission, any of the site improvements, designs, standards or conditions, required <br />for the property. <br />4. APPLICABILITY <br />The Minimum Maintenance Standards and Guidelines shall be applicable to all unimproved <br />and improved properties within the geographical boundaries of the City of Casselberry, <br />Florida. Said Minimum Maintenance Standards and Guidelines shall be in addition to any <br />other standards, codes, ordinances, rules, regulation or other statutory requirements applicable <br />to such properties. Nothing herein shall be construed to repeal the requirements of Article <br />VIII, Section 2-8.1 through 2-8.9 of the Unified Land Development Regulations. To the <br />extent that this Ordinance conflicts with said requirements of the City Code, Sections 2-8.1 <br />through 2-8.9 shall preempt the terms of this Ordinance. <br />5. ENFORCEMENT <br />The Minimum Maintenance Standards and Guidelines shall be enforced pursuant to the <br />provision of Chapter 2, Article IV, Division 2, entitled "Code Enforcement Board," and <br />Chapter 2, Article V, of the Code of the City of Casselberry, Florida, entitled "Code <br />Enforcement Citations." A violation of any part of this Ordinance shall be a civil infraction <br />for which the penalty shall be $100 (Class II). <br />Ord. #95-853 Page 3 of 4 <br />
