<br />CASSELBERRY CITY COMMISSION <br />Minutes of October 12,2009- Regular Meeting <br />Page 4 of 13 <br /> <br />for both plans on March 10, 2008 (SPR 08-04). The previously approved extensions will expire on October 8, <br />2009. The property owner is requesting a second extension due to a change in the development plans for the <br />Wal-Mart site. <br /> <br />The Planning and Zoning Commission recommended approval of SPR 09-10 with the following conditions: <br /> <br />I. The Casselberry Exchange Master Site Plan modification (SPR 06-28) as approved by the City <br />Commission on October 8,2007, including the site plan dated August 22,2007 and all general notes in the site <br />plan package and conditions of approval shall be upheld by the owner and their successors or assigns. <br /> <br />2. The Wal-Mart site plan (SPR 07-13) as approved by the City Commission on October 8,2007, <br />including the site plan dated August 22, 2007 and all general notes in the site plan package, the side <br />development agreement, and the conditions of approval shall be upheld by the owner and their successors or <br />assigns, unless a new site plan is approved for the property. <br /> <br />3. Both site plan approvals shall be validfor an additional year and shall be extended to October 8, <br />2010. If deemed necessary, an additional extension request must be submittd prior the expiration. <br /> <br />4. No construction shall begin prior to the issuanceof site engineering permits by the City's Public <br />Works Department. <br /> <br />Budget Impact: This item does not impact the City's budget. <br /> <br />Recommendation: The City Manager and the Community Development Directorrecommended approval of <br />Resolution 09-2082, including the Planning and Zoning Commission's conditions of approval for the <br />Casselberry Exchange Master Plan. <br /> <br />C. Resolution 09-2083 - Consulting Services Agreement with J.R. Giese Operations, <br />LLC for Water Ouality Improvement Projects and Related Budget Amendment #10-003 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, EXECUTING A CONSULTANT <br />AGREEMENT WITH J.R. GIESE OPERATIONS, LLC (JRGO) TO PROVIDE <br />CONSTRUCTION/DESIGNENGINEERING AND GRANT ADMINISTRATION SERVICES FOR <br />THE CITY OF CASSELBERRY'S WATER QUALITY IMPROVEMENT PROJECTS RECENTLY <br />APPROVED BY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP); <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Introduction: Resolution 09-2083 provides for approval of an agreement with J.R. Giese Operations, LLC <br />(JRGO) for providing construction engineering, design engineering and grant administration services for the <br />water quality improvement projects the City will be rteasing for construction to improvethe City's potable <br />water distribution system. <br /> <br />Budget Impact: JRGO has proposed a fee of $298,100 that is directly reimbursable by FDEP. Budget <br />Amendment # I 0-003 increases the budget from Grant Revenue (401-0000-331.10-00) for the proceeds that <br />will be used for the consulting services. The cost ofthe services will be capitalized with the projects. The <br />budget for New Water Lines (401-0751-536.63-11) is increased for the spending. The City will be required to <br />pay the Consultant invoice and then submit for reimbursement from FDEP. <br />
