Staff Presentation: Mr. Gerald Paradise, Community Development Director, stated Ordinance 09-1303 provides for the voluntary annexation of a parcel ofland and residential structure located at 2586 Lake Howell Lane, east of State Road 436. Mr. Paradise distributed revised cover memorandums for this item to the City Commission which corrected scrivener's errors in the budget impact section. The annexation petition received in 2005 was recorded to run with the property. The subject property is adjacent and contiguous to the City limits; it will not create an enclave, is reasonably compact, and is in an urban area, meeting the statutory criteria for annexation as established in Chapter 171, Florida Statutes. Seminole County was provided notice of the annexation prior to August 7, 2009, pursuant to Chapter 171, Florida Statutes. The subject property has a Seminole County Low-Density Residential future land use and A-I (single family) zoning designation. Budget Impact: The property is valued at $207,002 and currently provides $939 in County property taxes. The property will provide $1,013 in City property taxes and an estimated $1,258 total fiscal impact as currently developed. Recommendation: The City Manager and the Community Development Director recommended approval of Ordinance 09-1303 on first reading. MOTION: Commissioner Solomon moved to approve Ordinance 09-1303 on first reading as presented. Motion was seconded by Vice Mayor Hufford. Motion carried unanimously by voice vote 5 - O. A. Ordinance 09-1304 - Voluntary Annexation of758 Lake Howell Lane The City Clerk read Ordinance 09-1304 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORiDA, RELATING TO VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORiDA, CERTAIN LANDS LOCATED IN SECTION 28, TOWNSHIP 21, RANGE 30; REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORiDA; PROVIDING FOR THE INTERiM PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT EFFECTIVE IN ACCORDANCE WITH LAW THE ARE TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE CERTIFIED.
