First Reading of Ordinance 09-1302 - Moratorium on Specific Business Uses <br /> <br />The City Clerk read Ordinance 09-1302 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, IMPOSING A TEMPORARY <br />MORATORIUM ON THE ISSUANCE OF ANY BUSINESS TAX LICENSE, PERMIT, <br />CONDITIONAL USE APPROVAL, SITE PLAN APPROVAL AND ANY OTHER OFFICIAL <br />ACTION OF THE CITY OF CASSELBERRY HAVING THE EFFECT OF PERMITTING OR <br />ALLOWING THE CONSTRUCTION AND/OR OPERATION OF CERTAIN BUSINESSES <br />WITHIN THE CITY OF CASSELBERRY, COMMONLY REFERRED TO AS P AWN SHOPS, <br />TATTOO PARLORS, USED AUTOMOTIVE SALES, AND INTERNET SWEEPSTAKES CAFES, <br />AS MORE SPECIFICALLY DESCRIBED IN THIS ORDINANCE, EXCLUDING APPROVALS <br />AND PERMITS FOR THE CONTINUANCE OF AN EXISTING BUSINESS; THE TEMPORARY <br />MORATORIUM SHALL APPLY TO ALL REAL PROPERTY LOCATED WITHIN THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY; PROVIDING A PROCEDURE FOR <br />EXTRAORDINARY HARDSHIP; PROVIDlNG FOR SEVERABILITY, CONFLICTS <br />AND AN EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 09-1302 was published in the <br />Orlando Sentinel on July 30, 2009. <br /> <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 09-1302 provides for a 175 day <br />moratorium on the issuance of business tax licenses, permits, development orders or any other official action to <br />allow new pawn shops, tattoo, parlors, body piercing salons, and used automobile uses with the City limits. <br />Adoption of this ordinance provides staff an opportunity to develop findings and determine if criteria are <br />needed for the location of these specific businesses within the City. The City Attorney noted that Section 5 <br />provides for a procedure for extraordinary hardships. <br /> <br />Budget Impact: This item has no budget impact. <br /> <br />Staff Recommendation: The City Manager and the Community Development Director recommended <br />approval of Ordinance 09-1302 on first reading. <br /> <br />Public Hearing: The following individual came forward to address Ordinance 091302: <br /> <br />1) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 091302. <br /> <br />No one else came forward to address Ordinance 091302. <br /> <br />MOTION: <br /> <br />Commissioner Miller moved to approve Ordinance 09-1302 on first reading. <br />Motion was seconded by Commissioner Solomon. <br /> <br />DISCUSSION: Commissioner Miller stated this matter relates to economic impact in planning for the <br />welfare of the City. The City Attorney clarified that there is no intention on <br />prohibiting these types of businesses in the City, and the purpose of the moratorium <br />is to allow a period of study which may Olmay not result in changes with regard to <br />these types of businesses. Commissioner Solomon spoke in favor of the moratorium. <br />Commissioner Doerner voiced concerns regarding the need of a moratorium, and felt <br />
