Mr. <br />Willard requested a 40% of 50% reduction to any of the tree fund payment alternatives on the replacement <br />variables chart presented by staff. <br /> <br />Mr. Dave Anders, 1035 Lancelot Way, stated he was a member of Kingdom Hall and spoke in favor ofa <br />reduction, citing the unique site conditions, and voicing concerns regarding the code requirements and <br />stormwater requirements that have mandated the loss of trees on the property. <br /> <br />Mr. David Koutek, 180 River Oak Circle, Sanford, requested that the City Commission act reasonably under <br />the Code. <br /> <br />Mr. Michael Borgailo, 925 Saza Run, spoke in favor of a waiver because it was allowed by the City Code, <br />and cited the site conditions and stormwater and parking requirements for the site, as well as the nature of <br />the ownership of the property. <br /> <br />Mr. Steve Kolarits, 27 Bayberry Branch, cited the number of Kingdom Hall members in the audience and <br />stated volunteers would be planting the trees on the site. <br /> <br />Lengthy discussion ensued regarding the various replacement variables and past interpretation of the City <br />Code and prior waivers given by the City. The City Commission decided to utilize the $220 per tree <br />installation cost, and a total tree deficit of345.8 inches, based on all the credits outlined in the replacement <br />variables chart which would result in a payment to the Tree Fund in the amount of $78,760. <br /> <br />MOTION: Commissioner Solomon moved to modify the Planning <br />and Zoning Commission's decision for the Kingdom <br />Hall site plan (SPR 06-12) to reduce the standard for <br />tree species from a Florida grade 1 to Florida grade 2; <br />to reduce the current wholesale value of2.5" DBH live <br />oak of $220 resulting in a reduction of the total tree <br />replacement deficit to 345.8 inches and a payment to <br />the Tree Fund in the amount of$78,760, as outlined in <br />the replacement variables chart; and to eliminate the <br />requirement for the City Attorney to prepare an <br />agreement regarding the effect of a change in use of the <br />Kingdom Hall property. Motion was seconded by <br />Commissioner Doerner. <br /> <br />DISCUSSION: Discussion ensued regarding the intent and interpretation ofthe City Code <br />for this waiver and past waivers granted by the City, as well as <br />environmental impact issues. <br /> <br />Motion carried unanimously by voice vote 5 - O. <br /> <br />Mayor Glancy noted the time and inquired if the City Commission wished to modify the agenda in light of <br />the time remaining. <br />
