ORDINANCE 10-1313 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING THE CITY OF CASSELBERRY, FLORIDA, CODE OF <br />ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS, AS FOLLOWS: AMENDING SECTION 2.5.3, LAND <br />USE BY DISTRICTS, TABLE 2-5.3 LAND USE BY DISTRICTS (1), <br />ARTICLE V, ZONING DISTRICT REGULATION, CHAPTER II, DISTRICT <br />AND GENERAL REGULATIONS, TO INCORPORATE REFERENCES <br />TO NON-TRADITIONAL USES INCLUDING "CHECK <br />CASHING/PAYDAY LOAN BUSINESSES", PROVIDE A MINIMUM SITE <br />SIZE FOR VEHICULAR SALES USES, AND ADDING A <br />CORRESPONDING FOOTNOTE FOR NON-TRADITIONAL USES; <br />CREATING A NEW SUBSECTION 2-7.30, "NON-TRADITIONAL <br />USES", ARTICLE VII, GENERAL REGULATIONS, CHAPTER II, <br />DISTRICT AND GENERAL REGULATIONS, PROVIDING CRITERIA <br />FOR THE OPERATION OF NON-TRADITIONAL USES; AMENDING <br />SECTION 5-21.2, DEFINITION OF TERMS, OF ARTICLE XXI <br />LANGUAGE AND DEFINITIONS, CHAPTER V, GLOSSARY, TO <br />INCLUDE THE DEFINITIONS FOR "BODY ART ESTABLISHMENT", <br />"NON-TRADITIONAL USES", AND "PAWN SHOP"; PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS, AND EFFECTIVE <br />DATE. <br />WHEREAS, numerous pawn shops, body art establishments, and vehicular sales businesses <br />have located within the city limits; and <br />WHEREAS, there is a concern that a proliferation of pawn shops, body art establishments, and <br />vehicular sales will decrease property values and threaten the aesthetics of the City, thus threatening the <br />public health, welfare and safety of the City; and <br />WHEREAS, the proliferation of pawn shops, body art establishments, and vehicular sales affect <br />the development and re-development efforts of the City of Casselberry; and <br />WHEREAS, the City Commission seeks to provide similar regulatory criteria to pawn shops, body <br />art establishments, check cashing establishments and vehicular sales business as other jurisdictions within <br />Seminole County; and <br />WHEREAS, vehicular sales locations may be safety hazards with sites that are less than one <br />acre; and . <br />
