August 2008 Property information was distributed to developers about these outparcels. Also, <br />these outparcels were marketed at the ICSC Conference, August 17, 2008 -August <br />19, 2008, In addition, a "Notice of Sale" for the City/CRA outparcels was placed in <br />the August 21, 2008 edition of the Orlando Sentinel. <br />October 2008 "For Sale" signs were posted on the City/CRA outparcels. Alcorn October of 2008 a <br />formal offer was made by Mr. Rubin to the CRA Board to purchase the CRA's two <br />parcels for $250,000 total, which equaled $8.00 per sq. ft. [psf) for the combined .71 <br />acres. This offer was denied by the CRA Board. During that time the City received <br />two other offers: 1) $13.00 psf for an ice cream shop (half acre site) and 2) $9 psf <br />for a dry cleaning establishment (.14 acre site). Both offers were rejected by the <br />CRA Board: inconsistent with the intent of the plan, inappropriate architectural <br />designs, and drive-thru business as main use is not allowed in the CRA. <br />November 2008 At the CRA Board meeting, Toppers Creamery submitted a request for <br />lease/purchase of the City/CRA owned Target outparcels. They offered <br />$279,968 ($13.00 psf) for the .49 acres and $54,936 ($9.00 psf) for the .14 <br />acre, totaling $334,904. Their request was denied due to inconsistency with <br />the intent of plan and that the architectural design would not work. Also at <br />the November 2008 CRA Board meeting, Sam Pinesar submitted a request to <br />purchase the .14 acre parcel. The reason for the denial was the proposal of <br />$79,000 was too little as well as a secondary business as a drive-thru is <br />permitted but not as a main use. His proposed use was to place a dry <br />cleaning drive-thru site on this location. <br />February 2009 Marlc Riley submitted a proposal for purchase of the .14 acre parcel to the <br />CRA Board. The proposed use was a 1,075 square foot Caribbean Cream Ice <br />Cream establishment. His offer was $90,000. The CRA Board appreciated his <br />interest in starting a business in the City but denied the request with the <br />intent of a developer assembling the three parcels. <br />April 2009 Mr. Rubin inquired again about the CRA accepting his offer of $250,000 for <br />both parcels. City staff suggested equally splitting the parcels so that each <br />party would have a larger parcel to try to develop. Mr. Rubin responded <br />that he did not feel that was a good solution and again inquired about the <br />CRA selling him the parcels for $250,000. Mr. Rubin inquired about <br />drainage for the property and whether or not he could drain into the <br />existing retention pond area [water tower). Public Works responded that <br />the Target pond is at maximum capacity due to modifications to handle the <br />Triplet roadway project. This information had previously been conveyed to <br />Mr. Rubin. Also, Mr. Rubin was encouraged to hire a land developer to assist <br />him with drainage issues for his parcel. Also in April 2009, Mr. Rubin <br />admitted that he was upside down on the lot and that he had made a bad <br />business decision when he brought the lot. Staff advised that he could not <br />
