ORDINANCE 95-831 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 86, ARTICLE II, SEWERS, OF THE CITY CODE OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR TIME EXTENT FOR CONNECTION FEE REDUCTION & SEPTIC TANK ELIMINATION POLICY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WI~REAS, the Sanitary Sewer element of the Comprehensive Plan encourages the elimination of septic systems; and WHEREAS, the City of Casselberry wishes to develop policies and procedures to implement elimination of septic tank systems. NOW, THEREFORE, BEIT ENACTED BYTHE CITYCOMMISSIONOFTHE CITYOF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Paragraph 86-68(d) of the City Code of the City of Casselberry, Florida, is hereby amended to add a new sentence a$er the first paragraph to read as follows: (d) Septic tank exception. Notwithstanding other Sections of this Code, all properties in the service area shall have until January 2, 1996, to exercise this privilege and thereby shall also have waived the flow-by availability charge in the interim. SECTION V. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION VII. Severability. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION VIII. Effective Date. This Ordinance shall become effective ten (10) days after its passage and adoption. FIRST READING this day of ':' . , A.D. 1995.
