ORDINANCE 10-1311 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORH)A, AUTHORIZING THE EXECUTION OF A <br />COOPERATIVE PURCHASE FRANCHISE AGREEMENT <br />WITH WASTE PRO OF FLORH)A, INC., FOR <br />RESIDENTIAL SOLID WASTE COLLECTION SERVICES; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselbeny is dedicated to providing cost-effective solid waste <br />collection services for its residents; and <br />WHEREAS, in October 2008, via Ordinance 08-1249, the City Commission approved a <br />cooperative purchase agreement with Waste Pro of Florida, Inc., (Waste Pro) as a means of <br />providing reasonable, cost-effective residential solid waste collection services based on a contract <br />between Waste Pro and Seminole County; and <br />WHEREAS, the Franchise Agreement with Waste Pro of Florida, Inc., for residential solid <br />waste collection services is reaching the end of its term (March 31, 2010); and <br />WHEREAS, Seminole County selected Waste Pro under a competitive bid process in <br />October 2009 to provide exclusive solid waste collection services for a specific portion of <br />unincorporated Seminole County; and <br />WHEREAS, Waste Pro has again agreed to extend those same terms and conditions in the <br />Seminole County Franchise Agreement to the City of Casselberry; and <br />WHEREAS, the City's purchasing policy allows for a cooperative purchase, or <br />"piggyback"; and <br />WHEREAS, the agreement with Waste Pro provides for an annual consumer price index <br />(CPI) increase for the period of January 1 through December 31 of the previous year as well as bi- <br />annual fuel adjustments in accordance with said agreement; and <br />WHEREAS, upon adoption, the new rates charged to the City's residential solid waste <br />customers will be $18.42/month per home for regular and special collection services (a decrease <br />from $18.48/month currently assessed), and $28.42/month per home for side door collection <br />services; and <br />WHEREAS, via this ordinance, the aforementioned monthly residential solid waste <br />collection rates will be established and will become effective on April 1, 2010; and <br />WHEREAS, all future rate adjustments with Waste Pro, to include consumer price indices <br />and fuel adjustments, will be established via resolution; and <br />
