He said at the July 28, 2010 meeting the Planning and Zoning Commission continued the <br />item to allow the applicant time to remove the underbrush from the site so the remaining ten tree stumps could be <br />examined. Mr. Raasch said due to financial hardship the applicant did not remove the underbrush on the site; <br />therefore, staff was unable to gather new information on the case. <br />Mr. Raasch reviewed the information provided in his memos dated June 17, 2010 and July 23, 2010, <br />supported by a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department). He said it was documented that 14 trees were removed from the <br />site; however it was determined that 4 trees were exempt from tree protection requirements and were removed from <br />the analysis. He said the original tree replacement figures were recalculated based on information from the United <br />States Department of Agriculture Forest Service estimating the probable dbh of the trees removed from the site and <br />an updated tree replacement cost. He said the revised replacement cost is $61,200. <br />Mr. Raasch stated that the applicant has requested the replacement requirement be waived due to the <br />condition of the trees and a financial hardship. Mr. Raasch reviewed the purpose and intent of the tree protection <br />requirements and the criteria required to grant a waiver. <br />Mr. Raasch stated Staff does not support the proposed waiver based on the findings of fact. He said that <br />the Planning and Zoning Commission approval of SPR 10-07, for a tree removal permit and a waiver from <br />replacement requirements for the property located at 95 Concord Drive, would be based on the Planning and Zoning <br />Commission's findings of fact and conclusions of the staff report dated July 23, 2010 and the following conditions: <br />1. The applicant is exempt from tree replacement requirements for 269" (dbh). <br />2. All future development will require additional site plan review by City Staff and the Planning and Zoning <br />Commission. <br />3. No further site engineering construction activities shall take place at the site until permits are issued by the <br />City's Public Works Department. <br />4. All permits from appropriate State and County agencies shall be obtained prior to the submittal for a site <br />engineering permit to the City's Public Works Department. <br />He said that the Planning and Zoning Commission denial of SPR 10-07, for a tree removal permit and a <br />waiver from replacement requirements for the property located at 95 Concord Drive, would be based on the findings <br />of fact and conclusions of the staff report dated July 23, 2010 and the following conditions: <br />
