ORDINANCE 10-1330 <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY, <br />FLORIDA, CODE OF ORDINANCES, PART II, CHAPTER 14, <br />AMUSEMENTS, AMENDING SECTION 14-28, PERMIT REQUIRED, <br />ELIMINATING AN EXEMPTION FROM PERMITTING; AMENDING <br />SECTION 14-31, PERMIT FEE, ELIMINATING THE PERMIT FEE <br />SCHEDULE; AMENDING SECTION 14-53, OPEN AIR FOOD SALES, <br />PERFORMANCE CRITERIA, TO IMPOSE VENUE AND LOCATION <br />RESTRICTIONS ON OPEN AIR FOOD SALES, INCLUDING MOBILE FOOD <br />VENDING CARTS AND WAGONS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. (LPA 10-03) <br />WHEREAS, Chapter 14, Amusements, Article II, Special Events, Open Air Sales, Open Air Food <br />Sales, Seasonal Sales, and Temporary Structures, was adopted by the City Commission by Ordinance 97- <br />883 on May 5, 1997; and <br />WHEREAS, the City of Casselberry will establish policies and fees for the various activities that <br />occur on city-owned properties and these policies and fees may conflict with those established in Chapter <br />14 for privately owned property; and <br />WHEREAS, the permit fee schedule requires amending to recognize the various fees for mobile <br />vendors to participate in a Special Event, Open Air Sale or a Seasonal Sale; and <br />WHEREAS, mobile vending carts and wagon sales is a permitted use as part of an approved <br />special event, as a mobile vendor within the City limits, and as an accessory use to a permanent business <br />location as a conditional use; and <br />WHEREAS, the City Commission seeks to eliminate the ability for mobile vendors to set up a <br />business within parking, open space and traffic areas of business locations within the City on a permanent <br />basis; and <br />WHEREAS, the City Commission seeks to eliminate the ability for mobile vendors to set up a <br />business within parking, open space and traffic areas of business locations within the City on a temporary <br />basis unless in conjunction with a special event, seasonal sale or open air sale; and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on <br />the proposed changes set forth herein and considered advice of staff, citizens, and all interested parties, <br />and after complete deliberation, hereby finds the requested changes consistent with the City of <br />Casselberry's Comprehensive Plan; and <br />
