Mr. Sabin stated he was aware <br />that the various types of (zoning) designations provided for the Commercial designation would limit the intensity of <br />the uses, although he would prefer that the neighborhood remain residential. Ne also stated his concern that <br />changing the code "administratively" would allow staff to easily change the code back "administratively". Ms. Smith <br />clarified that the term in the property owner notification letter stating that "administratively amending" the code meant <br />that the applicant is the City, not a private individual. She further stated that, as with any change to the Code, three <br />public hearings are required to change the Code. <br />Mr. Parkhurst asked for a motion to address LPA 10-02. Mr. Aramendia recommended continuance of LPA <br />10-02 to the June 23, 2010 meeting. Mr. Bakalla seconded the motion. The motion passed unanimously by voice <br />vote. <br />Fourth Item of Business: LPA 1006: ULDR MTMU• Table 2.4 2 and 2.8 (non conformities Amending the <br />Unified Land Development Regulations to allow the continuation of structures and uses after significant fire <br />or storm damage based on the properties zoning and future land use designation prior to receiving an MTMU <br />flu designation. <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated May 26, <br />2010, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). She stated that this action amended the Code in two locations to address the concerns of those <br />property owners whose properties were receiving a future land use map amendment to Major Thoroughfare Mixed- <br />Use (MTMU), <br />After a brief discussion, Mr. Parkhurst asked if there was anyone in the audience who wished to speak in <br />favor of, or in opposition to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida <br />came forward. Mr. Casselberry stated that the eighteen month limitation to obtain a building permit would not be <br />enough time for those who may have to litigate with their insurance company, especially should they need a legal <br />appeal. He suggested an exception to those in litigation. <br />Mr. Parkhurst asked for a motion to address LPA 10-06. Mr. Aramendia recommended approval of LPA 10- <br />06 to the City Commission based on the staff report for LPA 10-06 dated May 26, 2010 from Ms. Smith to the <br />
