Section 2-7.10. Fences and walls. *~* C. Residential fences or walls. In any residential district, no fence or wall shall be erected or project beyond the property maintained right-of-way line. For the purpose of this section of the code, a front yard is defined as the area between those property lines adjacent to the street and the principal structure. No wall or fence in excess of three feet may be maintained within a front yard as indicated in the detail below. Principal Structure Front yard Principal Structue Front yard 1. Front vard fences. Fences within the front yard forward of the front building line of the main building shall be limited to a maximum height of 3 feet; provided, however, that they be of approved, open decorative type construction, such as open chainlink, wood, vinyl, aluminum, or split rail fencing. 2. Side and rear vard fences. Side and rear yard fences or walls may be erected or maintained to a maximum height of six feet above the finished grade. 3. Material. All fences or walls shall be constructed from approved material enumerated herein and shall be erected with Piave the finished side facing out. Barbed wire or similar materials shall not be allowed in any residential districts. 4. Undeveloped properties. Undeveloped residential properties may be fenced upon approval by the Administrative Official of the location and material type. 5. Non-compliant fences and walls. Leaallv existina non-compliant fences and walls on residential properties may be replaced. restored. or reconstructed as oriainally permitted. Such replacement. restoration. or reconstruction shall adhere to the current permittina reauirements expressed within this section. The burden of proof in establishina the leaal non-compliant status of an existina fence or wall rests solely with the a glicant. Those applicants who are unable to effectively prove such legal non- compliance shall be subject to the current fence and wall regulations of this section. SECTION 2. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION 3. CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be Ordinance 10-1331 Fence Maintenance Page 2
