Section 2-7.10. Fences and walls. <br />*~* <br />C. Residential fences or walls. In any residential district, no fence or wall shall be erected or project <br />beyond the property maintained right-of-way line. For the purpose of this section of the code, a front yard is <br />defined as the area between those property lines adjacent to the street and the principal structure. No wall <br />or fence in excess of three feet may be maintained within a front yard as indicated in the detail below. <br />Principal Structure <br />Front yard <br />Principal Structue <br />Front yard <br />1. Front vard fences. Fences within the front yard forward of the front building line of the <br />main building shall be limited to a maximum height of 3 feet; provided, however, that <br />they be of approved, open decorative type construction, such as open chainlink, wood, <br />vinyl, aluminum, or split rail fencing. <br />2. Side and rear vard fences. Side and rear yard fences or walls may be erected or <br />maintained to a maximum height of six feet above the finished grade. <br />3. Material. All fences or walls shall be constructed from approved material enumerated <br />herein and shall be erected with Piave the finished side facing out. Barbed wire or <br />similar materials shall not be allowed in any residential districts. <br />4. Undeveloped properties. Undeveloped residential properties may be fenced upon <br />approval by the Administrative Official of the location and material type. <br />5. Non-compliant fences and walls. Leaallv existina non-compliant fences and walls on <br />residential properties may be replaced. restored. or reconstructed as oriainally <br />permitted. Such replacement. restoration. or reconstruction shall adhere to the current <br />permittina reauirements expressed within this section. The burden of proof in <br />establishina the leaal non-compliant status of an existina fence or wall rests solely with <br />the a glicant. Those applicants who are unable to effectively prove such legal non- <br />compliance shall be subject to the current fence and wall regulations of this section. <br />SECTION 2. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Ordinance. <br />SECTION 3. CODIFICATION. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of <br />the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be <br />Ordinance 10-1331 <br />Fence Maintenance <br />Page 2 <br />
