®RDINANC 10.1332 <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY, FLORIDA, CODE OF ORDINANCES, PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, <br />"DISTRICT AND GENERAL REGULATIONS" TO ADD A FOOTNOTE <br />TO TABLE 2.4.2, "FUTURE LAND USE MAP DESIGNATIONS AND <br />ZONING DISTRICTS"; AMENDING SECTION 2.8.1, "PURPOSE AND <br />INTENT" OF ARTICLE VIII, "NONCONFORMING USES AND <br />NONCOMPLIANT STRUCTURES"; PROVIDING FOR SEVERABILITY, <br />CODIFICATION, CONFLICTS, AND EFFECTIVE DATE. (LPA 10.06) <br />WHEREAS, the City Commission adopted the Major Thoroughfare Mixed Use future land use <br />category to allow increased development intensities and densities along the City's major arterial corridors of <br />US Hwy 17-92 and SR 436; and <br />WHEREAS, the City Commission amended the City of Casselberry Future Land Use Map to apply <br />the Major Thoroughfare Mixed Use to numerous properties; and <br />WHEREAS, the future land use change restricts the percentile mix of uses for properties that may <br />not be able to redevelop to the higher intensity at this time; and <br />WHEREAS, application of the requirements within Article VIII, Non-Conforming Uses and Non- <br />compliant Structures, would be a hardship on those properties until the properties can be aggregated for <br />re-development or the economy improves; and <br />WHEREAS, the intent of the City Commission is to provide an opportunity to property owners and <br />not to create a hardship; and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on <br />the proposed changes set forth herein and considered advice of staff, citizens, and all interested parties <br />submitting written and oral comments and supporting data and analysis, and after complete deliberation, <br />hereby finds the requested changes consistent with the City of Casselberry's Comprehensive Plan; and <br />
