ORDINANCE NO. 99-947 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA <br />AMENDING THE CITY OF CASSELBERRY CODE OF ORDINANCES <br />SECTION 62.322 TO ADD SUBSECTION (D) THAT PROVIDES FOR <br />PAYMENT OF ACCRUED ANNUAL LEAVE UPON AN EMPLOYEE <br />ELECTING TO PARTICIPATE IN A DEFERRED RETIREMENT <br />OPTION PROGRAM THROUGH A CITY OF CASSELBERRY <br />RETIREMENT PLAN; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the State of Florida instituted an optional <br />retirement program where a member may retire and instead of <br />having the monthly retirement benefits paid directly to <br />them, it is paid into a tax deferred retirement account <br />administered by the State; and <br />WHEREAS, the Florida State Retirement System allows a <br />member to receive lump sum payment for accrued annual leave <br />and to have such payment included in the calculation of the <br />member's average final compensation; <br />WHEREAS, the employees of the City have requested the <br />option to receive such payment; <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Section 62.322 (d) Persons, participating in a <br />deferred retirement option program offered through a <br />retirement benefit extended to City employees, may receive <br />payment for annual leave accumulated to the date of their <br />entering into the deferred retirement option program. <br />SECTION II. Codification. It is the intention of the City <br />Commission of the City of Casselberry, Florida, and it is hereby <br />ordained that the provisions of this Ordinance shall become and <br />be made a part of the Code of Ordinance of the City of <br />Casselberry, Florida; that the Sections of this Ordinance may be <br />renumbered or relettered to accomplish such intention; that the <br />word, "Ordinance", may be changed to "Section", "Article", or <br />other appropriate word. <br />SECTION IV. Conflicts. All Ordinances or parts of <br />Ordinances in conflict with any of the provisions of this <br />Ordinance are hereby repealed. <br />SECTION V. Severability. If any Section or portion of a <br />Section of this Ordinance proves to be invalid, unlawful, or <br /> <br />
