ORDINANCE 94786 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SUBSECTIONS 42-59 AND 62-119 OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR EXPANDED RESIDENCE RADIUS FOR 56 HOUR PERSONNEL; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, employees of the City of Casselberry are required to reside within a 25- mile radios of the geographical boundaries of the City, and WHEREAS, those employees assigned to work 56-hours per week are required to report to work only every third day for 24 hours; and WHEREAS, growing populations and land area density result in building and development in fringe areas that can provide competitive housing and cost of living benefits; and WHEREAS, there are no foreseeable negative impacts to limited expansion of the current geographic residential requirement with respect to 56-hour per week personnel; NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Subsection 42-59 (c) is hereby amended as follows: (c) Other officers. All other permanent Department officers shall be appointed by the City Manager, and their positions shall be classified service positions. These officers shall be accountable only to the City Manager and the Chief. All officers must reside with a 15-mile radius of the geographical boundaries of the City except for officers assigned to 56-hour per week dui. SECTION H. That Subsection 62 119 (2) is hereby amended as follows: (2) ~ Be legal residents of the City, or reside within a 25-mile radius of the geographical boundaries of the City, or agree to become, within six months after appointment, legal residents of the City or to reside within a 25-mile radius of the geographical boundaries of the City, as provided in Section 62- 120, subject, however, to the more restrictive residence requirements specified in Section 42-59. bL1 Notwithstanding subsection (2Za above, 56 hour per week personnel must reside within a 45 mile radius of the geographical boundaries of the CitX within six months after appointment to a 56 hour per week position with the City.
