Return to: <br />Pamela Lynch <br />City of Casselberry <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br />AI~11~TE~ATI®N AGI~EIVIEI+1'I' <br />THIS ANNEXAT ON AGREEMENT ("Agreement") is made and entered into this <br />~~P1 day of ~ , 2010, by and between the CITY ®F CASSEI,~I+; Y, a <br />municipal corporation organize d and existing under the laws of the State of Florida, whose <br />address is 95 Triplet Lake Drive, Casselberry, FL 32707, (the "City"), and GA'I'I+;II®iJSE <br />S>LTI~SI~AD®W, LLC, a Florida limited liability company, whose address is 3850 Bird Road, 8t'' <br />Floor, Miami, FL 33146 ("Sunshadow"). <br />I2ECI'I'ALS: <br />WHEREAS, Sunshadow hereby attests that it holds fee simple title in and to that certain <br />parcel of real property described in Exhibit "A", attached hereto and made a part hereof by this <br />reference (the "Property"), and as shown on the map attached hereto as Exhibit "B", a portion of <br />which constitutes the private road known as, Sunshadow Drive ("Sunshadow Drive") as <br />described in the legal and shown in the sketch attached as Exhibit "C"; and <br />WHEREAS, the Property is located within the unincorporated jurisdictional limits of <br />Seminole County, Florida; and <br />WHEREAS, the City desires to extend the boundaries of its municipal jurisdiction by <br />annexing the Property in accordance with the procedure for annexation as set forth in Section <br />171.044, Florida Statutes; and <br />WHEREAS, the City has determined that it can enhance the level of municipal services <br />being provided to the Property and that the annexation will be of significant permanent benefit to <br />the City and its residents; and <br />WHEREAS, Sunshadow acknowledges that the City is under no legal obligation by <br />virtue of this Agreement to annex the Property, and that the City shall retain at all time the full <br />power and discretion to reject or deny annexation; and <br />WHEREAS, the purpose of this Agreement is to set forth the understanding and <br />agreement of the City and Sunshadow with respect to the matters set forth herein. <br />
