<br />ORDINANCE NO. 09-1309 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING ARTICLE VIII, AUTOMATED RED LIGHT <br />ENFORCEMENT, SECTION 82-238, OWNER <br />RESPONSIBILITIES AND SECTION 82-239, APPEAL TO <br />HEARING OFFICER, OF THE CITY OF CASSELBERRY CODE <br />OF ORDINANCES TO PROVIDE FOR A HEARING IN THE <br />EVENT A NOTICE OF INFRACTION IS NOT TIMELY RECEIVED; <br />PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS <br />AND EFFECTIVE DATE. <br /> <br />WHEREAS, the City adopted Ordinance 08-1246, codified in the City's <br /> <br />Code of Ordinances in Article VIII, Automated Red Light Enforcement, <br /> <br />authorizing the use of unmanned cameras/monitoring systems to promote <br /> <br />compliance with red light signal directives and adopting a civil enforcement <br /> <br />system for red light signal violations; and <br /> <br />WHEREAS, the City has determined that in certain cases the registered <br /> <br />owner of the vehicle subject to a violation of this Article, through no fault of the <br /> <br />owner, may not receive a Notice of Infraction within the time period to appeal <br /> <br />said Notice; and <br /> <br />WHEREAS, the City finds and determines that certain portions of Sections <br /> <br />82-238 and 82-239 must be amended to provide for an opportunity for the owner <br /> <br />to request a hearing in such event to determine if the owner should be entitled to <br /> <br />appeal; and <br /> <br />WHEREAS, this Amendment does not alter the purpose or intent of the <br /> <br />ordinance establishing automated red light enforcement; and <br /> <br />WHEREAS, words with double underlined type shall constitute <br />
