<br />ORDINANCE NO. 09-1305 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRY, FLORIDA CODE OF <br />ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS TO AMEND ARTICLE VII, SECTION 2-7.17 "HOME <br />OCCUPATIONS" TO INCLUDE ADDITIONAL PROHIBITED USES, <br />PROHIBIT ON.SITE CUSTOMERS, REQUIRE PROPERTY OWNER <br />AUTHORIZATION DURING REVIEW PROCESS, AND VARIOUS <br />OTHER CHANGES AND UPDATES, PROVIDING FOR CONFLICTS, <br />SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, Chapter II, Article XVII, Section 2-7.17 of the Unified Land <br />Development Regulations (ULDR) of the Code of Ordinances of the City of Casselberry <br />was adopted by Ordinance No. 757 on March 1, 1993 and was amended by Ordinance <br />01-1045 on May 13, 2002 by the Casselberry City Commission; and <br /> <br />WHEREAS, these regulations include criteria for the approval, operation, and <br />location of home occupations; and <br /> <br />WHEREAS, it has become necessary to amend the existing home business <br />regulations to reflect modern economies, terminology, policies, and procedures; and <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission/Local Planning <br />Agency has held a public hearing on August 12, 2009 with due public notice to consider <br />the proposed home occupation amendments; and <br /> <br />WHEREAS, a Public Hearing on the question of amending the current City of <br />Casselbenry Home Occupation regulations has been duly held by the City Commission <br />in the City of Casselberry, Florida and at such hearing, interested parties and citizens <br />for and/or against the proposed amendments were heard; and <br /> <br />WHEREAS, words with double underlined type shall constitute additions to the <br />original text and strike through shall constitute deletions to the original text. <br /> <br />NOW, THEREFORE, BE IT ENACTED by the CIty Commission of the City of <br />Casselberry, Florida: <br /> <br />Section 2-7.17. Home occupations. <br /> <br />Home occupations shall only be allowed provided the following specified conditions <br />are met: <br /> <br />A. In any district where a home occupation is allowed, it shall be clearly <br />incidental and secondary to the use of the dwelling for dwelling purposes and <br />shall not change the character thereof or the character of the neighborhood. <br />
