<br />ORDINANCE 09-1299 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY CODE OF ORDINANCES, PART III, UNIFIED <br />LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND <br />GENERAL REGULATIONS, ARTICLE V, ZONING DISTRICT <br />REGULATIONS, SECTION 2-5.2(C)(2)(b)(vlll), COMPREHENSIVE <br />GRAPHICS PLAN, PROVIDING NEW CRITERIA FOR <br />GROUND/MONUMENT SIGNS WITHIN THE PMX-H (PLANNED MIXED <br />USE HIGH INTENSITY) ZONING DISTRICT; PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS, AND EFFECTIVE <br />DATE. <br /> <br />WHEREAS, Part III, Unified Land Development Regulations, of the Code of Ordinances of the <br />City of Casselberry was adopted by Ordinance No. 757 by the Casseiberry City Commission on March <br />1, 1993 with a March 1, 1993 effective date; and <br />WHEREAS, criteria was provided within Article II, District and General Regulations, for <br />pianned mixed-use developments; and <br />WHEREAS, within the Planned Mixed-Use zoning criteria an opportunity for a comprehensive <br />sign plan is provided within ULDR Section 2-5.2(C)(2)(b)(iii), Comprehensive Graphics Plan, <br />specifically for shopping centers in the High Intensity zoning districts located at an identified gateway <br />intersection; and <br />WHEREAS, the site that is eligible to request a "Comprehensive Graphics Plan" has increased <br />in area and composition and additional sign opportunities are needed; and <br />WHEREAS, the Planning and Zoning Commission conducted an advertised Public Hearing on <br />June 10, 2009; and <br />WHEREAS, the City Commission of the City of Casseiberry, Florida, conducted advertised <br />Public Hearings and has determined that the amendments to Part III, Unified Land Development <br />Regulations, Code of Ordinances of the City of Casselberry, Florida, are appropriate; and <br />WHEREAS, these amendments are consistent with the City of Casselberry's adopted <br />Comprehensive Plan; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text <br />and strike tAFEl~~A shall constitute deletions to the original text. <br />
