<br />This Instrument prepared by: <br />Communily Development Department <br />City of Casselberry <br />95 Triplellake Drive <br />Casselberry, Florida 32707 <br /> <br />ORDINANCE NO. 09-1296 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY <br />OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE <br />LAND USE MAP, ESTABLISHING THE FUTURE LAND USE MAP DESIGNATION OF <br />COMMERCIAL (C) FOR THE PARCELS AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br /> <br />and <br /> <br />WHEREAS, the property described in Section I is within the corporate boundary of the City of Casselberry; <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a public <br />hearing with due public notice to consider this Comprehensive Plan Amendment; and <br /> <br />WHEREAS, a Public Hearing on the question of amending the City of Casselberry Future Land Use Map <br />designations of the properties hereinafter described, has been duly held by the City Commission of the City of <br />Casselberry, Florida, and at such hearing, interested parties and citizens for and/or against the proposed <br />establishment of the City of Casselberry Future Land Use Map designations were heard; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry, Florida, has considered the Comprehensive <br />Plan Amendment and has detenm/ned that the Future Land Use Map designations of said properties provided in <br />Section I, herein, shall be established as specified as those designations are defined in Future Land Use Element <br />Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and <br /> <br />WHEREAS, the proposed Commercial Future Land Use Map Designations are consistent with the City's <br />Comprehensive Plan; and <br /> <br />WHEREAS, such amendments are penmitted, subject to the provisions of Chapter 163 of the Florida Statutes <br />and Rule 9J-11 of the Florida Administrative Code. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry's Code of Ordinances, as amended <br />and supplemented, said Chapter adopting the City of Casselberry's Comprehensive Plan, regulating and restricting <br />the use of lands within the City of Casselberry, Florida, be, and the same is hereby amended to include property as <br />Commercial, for those parcels of land located on the west side of Lake Drive, south of Seminola Boulevard as shown <br />in Exhibit A and described as follows: <br /> <br />City of Casselberry, Florida <br />Ordinance No. 09-1296 <br />Page 1 of2 <br />
