<br />ORDINANCE NO. 09-1265 <br /> <br />AN ORDINANCE CREATING CERTAIN PROVISIONS OF <br />ARTICLE IX, CONCURRENCY MANAGEMENT, OF THE <br />CITY OF CASSELBERRY UNIFIED LAND <br />DEVELOPMENT REGULATIONS RELATING TO THE <br />PUBLIC SCHOOL FACILITY ELEMENT AND SCHOOL <br />CONCURRENCY; CREATING SECTION 3-9.11, PUBLIC <br />SCHOOL FACILITY CONCURRENCY AND PROVIDING <br />FOR SEVERABILITY, CODIFICATION, CONFLICTS AND <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Casselberry recognizes an <br />obligation and responsibility for the education, nurturing and general well-being of the <br />children within their community; and <br /> <br />WHEREAS, the City Commission agreed to enter into the 2007 Interlocal <br />Agreement for Public School Facility Planning and School Concurrency in January of <br />2008; and <br /> <br />WHEREAS, the City of Casselberry was authorized to enter into this interlocal <br />agreement pursuant to Section 163.D1, Section 163.3177(6)(h)2 and Section 1013.33, <br />Florida Statutes (F.S.); and <br /> <br />WHEREAS, this interlocal agreement requires the Cities, the County, and the <br />School Board to establish jointly the specific ways in which the plans and processes of <br />the School Board and the local governments are to be coordinated; and <br /> <br />WHEREAS, this interlocal agreement requires the Cities and County to adopt the <br />required school concurrency provisions into their land Development Regulations unless <br />electing to be bound by the provisions established by the County. <br /> <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br /> <br />SECTION 1. Section 3-9.11, of Article IX, Concurrency Manaaement, of the City <br />of Casselberry Unified Land Development Regulations is created to read as follows: <br /> <br />SECTION 3-9.11: PUBLIC SCHOOL FACtLlTY CONCURRENCY <br /> <br />A.
