<br />ORDINANCE NO. 07-1230 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, IMPOSING A TEMPORARY MORATORIUM ON <br />THE ISSUANCE OF ANY PERMIT, DEVELOPMENT ORDER, <br />SITE PLAN APPROVAL AND ANY OTHER OFFICIAL <br />ACTION OF THE CITY OF CASSELBERRY HAVING THE <br />EFFECT OF PERMITTING OR ALLOWING THE <br />CONSTRUCTION, OPERATION OR ERECTION OF AN <br />ELECTRONIC SIGN OR AN ANIMATED SIGN, AS MORE <br />SPECIFICALLY DESCRIBED IN THIS ORDINANCE, <br />EXCLUDING APPROVALS AND PERMITS FOR THE <br />MAINTENANCE OF AN EXISTING ELECTRONIC SIGN OR <br />ANIMATED SIGN; THE TEMPORARY MORATORIUM SHALL <br />APPLY TO ALL REAL PROPERTY LOCATED WITHIN THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY; <br />PROVIDING A PROCEDURE FOR EXTRAORDINARY <br />HARDSHIP; PROVIDING FOR SEVERABILITY, CONFLICTS <br />AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, electronic signs and animated signs are a recent technological <br />innovation used for signage, primarily due to their unusually strong and effervescent light <br />intensity; and <br /> <br />WHEREAS, there is a strong likelihood that electronic signs and animated signs will <br />proliferate throughout the City causing sign-induced visual blight, causing a decrease in <br />property values, threatening the aesthetics of the City, causing traffic safety problems by <br />way of distraction from attentive driving, thus threatening the public health, welfare and <br />safety of the City; and <br /> <br />WHEREAS, the proliferation of electronic signs and animated signs may become a <br />safety hazard for motorists, incompatible with residential neighborhoods and the proper <br />development of the City; and <br /> <br />WHEREAS, the City of Casselberry has found that it is necessary to impose a <br />temporary moratorium to allow sufficient time for the City to study, review, hold additional <br />public hearings, prepare and adopt new regulations for electronic signs and animated <br />signs; and <br /> <br />WHEREAS, a temporary moratorium on permitting the construction or erection of <br />electronic signs and animated signs will result in identification of the most appropriate <br />regulation of electronic signs and animated signs for the City, the protection and <br />enhancement of the adjacent uses, and the adoption of a regulatory ordinance, as <br />appropriate; and <br />
